Chapter 180 - 175: Mom on the Offensive
"The court has reviewed and deemed that the case is clear in fact and ample in evidence after investigation and court debate.
During the existence of their marriage, Ye Qiu and Kong Lizhi had marital discord, with Kong Lizhi being unfaithful to the marriage and transferring marital property and forging debts during the time the marriage was intact.
The court holds that the defendant Kong Lizhi, with the purpose of illegal possession and with a significant amount involved, his actions constitute the Crime of Fraud; the defendant using the marital property to support a mistress and fathering an illegitimate child outside, his actions constitute the Crime of Bigamy. Plaintiff Ye Qiu’s allegations against the defendant Kong Lizhi for the two crimes are established.
According to the criminal facts, nature of crime, circumstances of Kong Lizhi and the extent of harm done to the plaintiff, based on Articles 21, 54, and 64 of the ’Marriage Law of the People’s Republic of China’, the verdict is as follows:
One, grant the plaintiff Ye Qiu’s request to dissolve the marriage with the defendant Kong Lizhi.
Two, award the custody of the child born during the marriage, Kong Wen Yin, to the plaintiff Ye Qiu, and the defendant Kong Lizhi shall pay alimony of eight hundred yuan on time monthly.
Three, the defendant Kong Lizhi shall bear all debts owed by himself, and must reclaim all property gifted to his mistress and illegitimate child.
Four, the defendant Kong Lizhi shall leave empty-handed.
