The best action to take now was to use Lilith's inherent Apparation-Disapparation ability and run away with Ekrizdis before the entire Ministry of Magic descended here.

Without his Luck backing him up, he didn't dare use Lilith's ability.
Even Dumbledore would catch on him disapparating, given Kai's low Luck now. Much less needed to be said about the Merlin's Staff.
